Constitution of Home Guards and Appointment in Kerala 2024
The Government is empowered to create a volunteer organization referred to as the “Home Guards.” Members of this organization will undertake a range of duties and responsibilities pertaining to the protection of individuals, the security of property, and the preservation of public safety, as outlined in this Act and its accompanying regulations. The Government may appoint one or more Commandants to supervise the Home Guards established under subsection (1). Furthermore, the Government may designate a Commandant-General for the Home Guards, who will be tasked with the comprehensive oversight and administration of the Home Guards throughout the State.
Navigating Resignation: Home Guards in 2025
A member of the Home Guards may resign from their position by giving at least one month’s notice to the Commandant overseeing their current service, if they wish to proceed with the resignation.
Punishment for Neglect Duties 2025
- The Commandant is empowered to suspend, demote, terminate, or impose a monetary penalty of up to fifty rupees on any Home Guards member under his command who neglects their duties or disobeys lawful orders or directives pertaining to their responsibilities. Furthermore, should a member be found guilty of disciplinary infractions or misconduct, the Commandant is authorized to take equivalent actions. Similarly, the Commandant-General holds the same authority over any Home Guards member appointed within his jurisdiction and may also terminate a member based on conduct that has led to a criminal conviction.
- Notwithstanding any provisions within this Act, the Commandant is authorized to terminate the service of any Home Guards member at any time, provided that specific conditions are met, should he determine that the member’s services are no longer required. The Commandant-General possesses the same authority regarding any member of the Home Guards assigned to a position under his command.
- When the Commandant-General or the Commandant issues an order to suspend, demote, dismiss, or impose a fine on a member of the Home Guards as specified in this section, they are required to document the order, including the rationale and a record of the inquiry conducted. Additionally, no such order may be issued without allowing the individual an opportunity to defend themselves.
Penalties Kerala Home Guard Officers 2025
- If any member of the Home Guards fails to respond to a summons issued under section 5 without a legitimate reason, neglects their duties as a member, or ignores any lawful directive related to their responsibilities, they will face penalties upon conviction. These penalties may include a term of simple imprisonment for up to three months, a fine not exceeding two hundred and fifty rupees, or both.
- In the event that a member of the Home Guards willfully fails or refuses to return their certificate of appointment or any other item as required by subsection (1) of section 9, they will also be subject to penalties upon conviction. This may result in imprisonment for up to one month, a fine not exceeding one hundred rupees, or both.
- No legal proceedings shall be initiated under subsection (1) or subsection (2) without the prior consent of the Commandant.
- A Police Officer is empowered to arrest, without a warrant, any person who commits an offense punishable under this section.
